Caterivo terms and conditions

The terms for using Caterivo, including restaurant accounts, ordering pages, quote tools, payments, billing and platform use.

These terms and conditions apply to the use of Caterivo, which is operated by JMartyn Digital.

Please read these terms carefully before using the Caterivo website, platform, admin area, restaurant pages, ordering tools, quote tools or payment features.

By using Caterivo, creating an account, managing a restaurant account, placing an order through a Caterivo-powered page, submitting a quote request, or otherwise using the platform, you agree to these terms.

1. About Caterivo

Caterivo provides online ordering, quote request, payment and admin tools for small food businesses.

Caterivo is a software platform. Caterivo is not a restaurant, takeaway, caterer, food producer, delivery company, marketplace or customer-finding service.

2. Who these terms apply to

These terms apply to website visitors, restaurant owners, business users, admin users, and customers using Caterivo-powered restaurant pages.

Where a customer places an order, submits a quote request, makes a payment, arranges collection, arranges delivery, or contacts a food business through Caterivo, the contract for the food, catering, goods or related service is between the customer and the relevant food business.

The food business is responsible for supplying its own customer-facing terms and conditions where needed.

3. Restaurant and business user responsibilities

Restaurant owners and business users are responsible for the information they provide through Caterivo.

This includes business names, contact details, menus, prices, item descriptions, images, opening hours, availability, collection information, delivery information, quote information, customer messages, policies, privacy information and customer-facing terms.

Restaurant owners and business users must make sure their information is accurate, lawful, up to date and not misleading.

4. Food, allergens and customer information

Restaurants and food businesses are fully responsible for the food and services they provide.

This includes food preparation, ingredients, allergen information, dietary information, food safety, hygiene, item availability, substitutions, delivery, collection, packaging, complaints, refunds, cancellations and customer service.

Caterivo does not prepare food, inspect food, provide allergen advice, verify ingredients, arrange delivery drivers or guarantee that a restaurant will accept, prepare, deliver or fulfil an order.

Customers with allergies, intolerances or dietary requirements should contact the relevant food business directly before ordering.

5. Restaurant customer terms

Restaurants using Caterivo may provide their own customer terms and conditions through their restaurant page.

Where restaurant-specific terms are provided, those terms are the responsibility of the restaurant.

If a restaurant has not provided customer terms, customers should contact the restaurant directly before ordering if they need more information about cancellation, refunds, delivery, collection, allergens, order changes or other customer rights.

Restaurants and food businesses must provide suitable customer-facing terms and conditions and privacy information before their Caterivo-powered ordering page can be made public.

Caterivo may refuse, delay, suspend or unpublish a restaurant page if the restaurant has not provided suitable customer-facing terms, privacy information or other required business information.

Restaurants are responsible for making sure their customer-facing terms, privacy information, allergen information, menu information, delivery information, collection information, cancellation policy and refund policy are accurate, lawful and suitable for their business.

6. Orders and quote requests

Caterivo allows customers to place online orders, submit quote requests and contact food businesses.

The restaurant or food business is responsible for deciding whether to accept, reject, prepare, fulfil, amend, refund or cancel an order or quote request.

Quote requests are enquiries unless and until the food business confirms a quote and any required payment has been completed.

7. Payments and Stripe Connect

Payments are processed securely by Stripe. Caterivo does not store customers' full card details.

Caterivo may use Stripe and Stripe Connect to support payments, connected restaurant accounts, onboarding, payment links, refunds, disputes, chargebacks, verification and payouts.

Restaurant owners and business users must comply with Stripe's own terms, policies and requirements.

Stripe may require restaurant owners or business users to provide information for identity checks, business verification, tax, risk, fraud prevention, payout or regulatory purposes.

Payments, payouts, refunds, disputes, chargebacks and payment verification may be handled through Stripe and may be subject to Stripe's own rules and dashboard information.

8. Caterivo subscription fees

The current subscription price and any available introductory or founding customer offer are shown on the Caterivo pricing page:

The price applying to a restaurant account will also be clearly shown before the subscription is started and confirmed through Stripe.

Some early customers may be offered a founding customer price. Where stated at signup, that price will continue for as long as the subscription remains continuously active, unless otherwise agreed.

If a founding subscription is cancelled and the customer later subscribes again, the price available at the time of the new subscription will apply.

Caterivo does not charge a Caterivo percentage commission or per-order fee.

Stripe payment processing fees are separate from Caterivo subscription fees.

New restaurant accounts may receive a free trial or other introductory offer. Caterivo may change, pause or withdraw offers for future customers.

9. Billing and cancellation

Restaurant subscriptions are managed through Stripe.

Restaurant owners can manage billing and cancellation through the Stripe customer portal made available from the restaurant admin area.

Unless agreed otherwise, subscriptions are billed monthly.

If a subscription is cancelled, access will usually continue until the end of the current paid billing period, unless access is suspended earlier because of misuse, non-payment, legal reasons, security concerns or breach of these terms.

10. Subscription refunds

Subscription fees are generally non-refundable once a paid billing period has started.

Caterivo may decide to offer a refund or credit at its discretion, but this does not create an automatic right to a refund unless required by law.

11. No customer-finding promise

Caterivo helps food businesses take direct orders, quote requests and payments online.

Caterivo does not promise to find customers, increase sales, improve search rankings, generate enquiries, provide marketing results or guarantee any level of revenue.

Restaurant owners remain responsible for their own marketing, customer relationships, pricing, products and business decisions.

12. Platform availability and changes

Caterivo aims to provide a reliable service, but access may occasionally be interrupted, delayed, restricted or unavailable.

This may happen because of maintenance, updates, technical problems, third-party provider issues, security concerns, internet problems, payment provider issues or events outside Caterivo's reasonable control.

Caterivo is an evolving platform. Features may be added, changed, paused, limited or removed over time.

13. Support

Support is provided by email or written contact channels.

You can contact Caterivo at hello@jmartyndigital.co.uk.

Caterivo aims to respond to support messages within 2 working days, but response times are not guaranteed.

14. Acceptable use

Users must not misuse Caterivo.

You must not use Caterivo for unlawful purposes, fraudulent activity, abusive behaviour, spam, misleading information, harmful content, unauthorised access attempts, interference with the platform, security testing without permission, reverse engineering, or anything that may damage Caterivo, its users, restaurants, customers, service providers or reputation.

15. Account security

Restaurant owners and admin users are responsible for keeping their login details secure.

You must tell Caterivo promptly if you believe your account has been accessed without permission.

Caterivo is not responsible for losses caused by a user's failure to keep account access secure.

16. Restaurant content and branding

Restaurants and business users remain responsible for the content they provide, upload or submit to Caterivo.

This may include names, logos, images, menu items, prices, descriptions, business details, policies, opening hours and customer-facing information.

By providing content to Caterivo, restaurants and business users give Caterivo permission to host, store, display, process, copy and use that content as needed to provide, operate, support and improve the platform.

Restaurants and business users must only provide content they have the right to use.

17. Caterivo intellectual property

Caterivo, the platform, software, design, layout, branding, text, features, admin tools and related materials belong to JMartyn Digital or its licensors, unless stated otherwise.

Users must not copy, reproduce, resell, modify, distribute or create competing products from Caterivo's software, design or platform materials without permission.

18. Privacy and data protection

Use of personal information is explained in the Caterivo privacy policy.

Restaurants and business users are responsible for handling any customer information they receive through Caterivo properly and lawfully.

Restaurants should make sure their own privacy information and customer terms are accurate and suitable for their business.

19. Suspension and termination

Caterivo may suspend, restrict or terminate access to the platform where reasonably necessary.

This may include non-payment, suspected fraud, misuse, security concerns, unlawful activity, harmful behaviour, breach of these terms, Stripe account problems, legal requirements or serious complaints.

Where reasonable, Caterivo will try to give notice before suspending or terminating access, but this may not always be possible.

20. Limitation of liability

Caterivo provides software tools to help food businesses manage orders, quote requests, payments and admin.

To the fullest extent permitted by law, Caterivo is not responsible for restaurant food, allergens, ingredients, hygiene, delivery, collection, order fulfilment, quote fulfilment, customer service, restaurant refunds, restaurant cancellations, customer disputes with restaurants, loss of profits, loss of business, loss of goodwill, indirect losses or issues caused by third-party services.

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

21. Third-party services

Caterivo depends on third-party services to operate parts of the platform.

These may include Stripe, Firebase or Google Cloud, Netlify, Resend, Cloudflare, Namecheap and other technical service providers.

Third-party services may have their own terms, policies, limits, fees, downtime, verification requirements or account rules.

Caterivo is not responsible for failures, delays, restrictions or decisions caused by third-party services outside Caterivo's reasonable control.

22. Changes to these terms

Caterivo may update these terms from time to time.

The latest version will be shown on this page. Continued use of Caterivo after changes are published means you accept the updated terms.

23. Governing law

These terms are governed by the laws of England and Wales.
